1.What the survey exchange is
The survey exchange (the “Exchange”) is a list in which students and researchers publish links to their own questionnaires built in Google Forms and fill in each other’s. Its aim is to find real respondents for non-commercial academic research on the basis of reciprocity: whoever fills in other people’s questionnaires earns points, and points can be spent on listing one’s own questionnaire.
The Exchange is operated by Moadlab s. r. o., Konopná ul. 3059/5, 934 01 Levice, Slovak Republic, Company ID (IČO) 57 704 406 (the “Provider”). These rules are annex 2 to the Terms of Service (www.aiprace.tech/legal/vop).
The Provider only runs a list of links and keeps the points. It does not host questionnaires, does not supply the forms and does not collect answers. We do not see the answers, have no access to them and do not store them: a questionnaire always sits in a form created by its author, and the answers go to the author.
We do not guarantee any number of answers, how fast they arrive or that they will be usable for a particular piece of research. The respondents of the Exchange are mostly students who take part voluntarily, so the result is a convenience sample and not a representative one. The publisher should describe the limits of the sample openly in the research.
2.Who may use the Exchange
The Exchange may be used by a natural person who:
- has an account on www.aiprace.tech with a confirmed e-mail address; the address of a disposable (temporary) mailbox is not enough,
- is an adult, that is at least 18 years old,
- uses a single account. Several accounts of the same person are forbidden.
We do not verify age. Whoever starts to fill in another person’s questionnaire confirms with a required box that they are 18 or older, and we keep that confirmation with its time on the ticket. The author confirms when listing that the questionnaire is meant for adults only (part 3.2). If one of the conditions is not met, or if someone abuses the Exchange (part 7), we may restrict or withdraw access to the Exchange.
3.Listing a questionnaire
A questionnaire is listed by its author (the “publisher”) as a listing in the Exchange. The following applies:
3.1 Link. Only a link to a form in Google Forms is allowed, in the shape https://docs.google.com/forms/... (the address for filling in) or https://forms.gle/.... We reject a link to any other address. If you delete the form or no longer want to share it, close the listing.
3.2 Four attestations. Before listing, the publisher must confirm that:
- (a) the form shows its own notice on the processing of personal data under Article 13 GDPR at the start, and the publisher is the controller of the answers (part 4),
- (b) the form does not ask for special categories of personal data under Article 9 GDPR (in particular health, religious belief, political opinions, sexual orientation, racial or ethnic origin, trade union membership, biometric or genetic data) or for data on convictions and offences under Article 10 GDPR,
- (c) the form is meant for adults only,
- (d) the questionnaire serves non-commercial academic research (for example a final thesis, a seminar paper, a study or a research project) and not marketing, sales, market research for a company or the collection of contacts.
We store the attestations and the time they were confirmed. The publisher is responsible for their truth.
3.3 Data in the listing. A listing contains a title, a short description, the language, the field, the target group, the estimated time to fill in, in minutes, and a pseudonym. Estimate the time honestly: it sets the number of points and the earliest time at which a fill can be confirmed. Do not write a name, e-mail, telephone number or any other data by which someone could be identified into the listing. Only a pseudonym is shown publicly. The service assigns it to you itself (in the form Student- and six characters); you do not enter or choose it, and it is the same on all listings of your account, so those listings can be linked by it.
3.4 Price. Listing costs 5 points or 5 Credits, as you choose. It is paid once, when you list. The payment is not refunded when the listing is closed, when it expires or when it is removed for a breach of the rules. If we remove a listing by mistake, or it is not published because of an error on our side, we will restore it, and if that is not possible we will return the points or Credits on request to info@aiprace.tech.
3.5 Validity and order. A listing is publicly visible for 30 days from listing or until the publisher closes it. If you close a listing, those who started a fill before it closed can still confirm it for 48 hours and receive the points for it (section 5.4). Listings are ordered by the points the publisher earned by filling in other people’s questionnaires in the last 30 days, then newest first. The order cannot be bought: points cannot be purchased and paying with Credits does not change the order.
4.The publisher as controller of the answers
The publisher decides the purposes and means of processing the answers to their questionnaire, and is therefore the controller of the answers within the meaning of the GDPR (or their school or institution is, where the research is carried out in its name). It follows that:
- the form must show, at the start, the information required by Article 13 GDPR: who the controller is and how to contact them, for what purpose the answers are processed, the legal basis, how long they are kept, to whom they are passed and what rights the respondent has,
- personal data may be collected only where and to the extent the research needs it; do not switch on the collection of respondents’ e-mail addresses in the form unless you need it,
- the publisher must follow the rules of their school, their supervisor and any ethics committee,
- requests from respondents for access, erasure and other rights are handled by the publisher.
The Provider does not see the answers: it has no access to the form or to its answers. It is therefore neither a processor nor a joint controller of the answers. If a respondent asks us for their answers, we refer them to the publisher. The form is operated by Google under its own terms; we are not responsible for how it works or for the settings the publisher chooses.
We do not tell the publisher which users filled in their questionnaire through the Exchange. The publisher sees only the number of fills.
5.Filling in another person’s questionnaire
5.1 Voluntary. Filling in is voluntary. Before you start, read the notice on the processing of personal data at the start of the form. If it is missing, if the form asks for data that seem excessive to you, or if it is meant for people under 18, do not fill it in and report it (part 8).
5.2 Ticket. You start a fill with a required confirmation that you are 18 or older (part 2). Then the form opens in a new tab and a ticket with the start time is created. You can confirm the fill only after a minimum time that matches the length of the questionnaire (always at least one minute). We reject an earlier confirmation.
5.3 Honest filling. Fill the questionnaire in yourself, truthfully and once. It is forbidden to fill it in automatically (with a script, a bot or an artificial intelligence tool), to fill it in for others or more than once, to confirm a fill you did not make, and to fill in your own questionnaire. We cannot verify that you really filled the questionnaire in. The confirmation is your declaration and is subject to checks under part 6.5.
5.4 Once, and for 48 hours after a listing closes. You can confirm each fill through the Exchange once. A new fill can be started only while the listing is active, but a fill you started while it was active you can still confirm after the publisher has closed it or its validity has ended, up to 48 hours after it was closed or expired. A removed listing cannot be confirmed. The minimum time (section 5.2) and the weekly cap (section 6.2) apply then too.
6.Points
6.1 Nature of points. Points are an internal unit of the Exchange. They are not money, not electronic money and have no cash value. They cannot be bought, sold, transferred to another person, paid out or exchanged for Credits or any other consideration. Points are not Credits within the meaning of the Terms of Service.
6.2 How you earn points. For each accepted fill of another person’s questionnaire you receive 1 point for every started 5 minutes of the questionnaire’s estimated time, at least 1 point. You can earn at most 30 points a week this way. All accounts with the same e-mail inbox are counted together. The limit applies at the time these rules are issued. We may change it, but a change affects only points earned after it.
6.3 How you spend points. Listing costs 5 points (or 5 Credits, part 3.4). Points cannot be spent otherwise.
6.4 Records. We record every credit and debit of points with the date and the reason; the balance is their sum. You can see the balance, the weekly progress and your fills in your account.
6.5 Removal of points. If a fill turns out not to have been valid (after a confirmed report, on suspicion of an automated or false fill, or where several accounts are involved), we debit the points for that fill again. If you have already spent them, your balance falls by the same amount and new points are first set off against it. Points debited again still count towards the weekly cap in part 6.2. We tell you about the removal in the way described in part 9.
6.6 Lapse. Points lapse without compensation when the account is deleted.
7.Forbidden conduct and content
In particular, it is forbidden to:
- list a questionnaire that does not meet one of the attestations in part 3.2, a link to a service other than Google Forms, or a link that redirects elsewhere, spreads malware or collects passwords or payment details,
- list a commercial survey, advertising, a contest, a political campaign, the collection of contacts for marketing, or an offer of products or services,
- list content that is unlawful, hateful, abusive, threatening, harassing or infringing the rights of others,
- commission, offer or promote the writing of final theses or parts of them for other people, or post such an offer in the Exchange,
- list a questionnaire meant for people under 18,
- give a false time estimate, description or target group,
- open several accounts, fill in questionnaires automatically, buy or sell points, or agree to confirm each other’s fills without actually filling anything in,
- circumvent these rules or the technical limits of the Exchange.
8.Reporting unlawful or unsuitable content
Anyone, even without registering, may report a listing or a questionnaire that they consider unlawful or in breach of these rules. We follow Article 16 of Regulation (EU) 2022/2065 on a Single Market for Digital Services (the “DSA”).
8.1 How. Each listing has a button to report it. A report can also be sent by e-mail to info@aiprace.tech with the address of the listing.
8.2 What a report contains. A category, a sufficiently substantiated explanation of why the content is unlawful or breaches the rules, the exact address of the listing, the name (or the name of the organisation) and e-mail address of the person reporting, and a statement that the person reporting believes in good faith that the information is accurate and complete.
8.3 Acknowledgement and assessment. We confirm receipt of a report to the e-mail address of the person reporting without undue delay. A person assesses the report, in a timely, diligent and non-arbitrary manner; we do not use automated decision-making. We tell the person reporting our decision without undue delay, together with information on the means of redress (part 9). The reasons go to a person who was signed in when they gave the report; to an address that somebody merely typed into the form we send only what was decided and the means of redress.
8.4 Measures. Depending on seriousness we leave the listing in place, remove it (and, after review, may restore it), debit the points for a confirmed invalid fill and, for repeated or serious breaches, restrict access to the Exchange. We may remove a listing without a report if we learn of the breach in another way.
8.5 Abuse of reports. A report made in bad faith and repeated manifestly unfounded reports are forbidden and may lead to restricted access to the Exchange.
8.6 Point of contact. For users and for the authorities of the Member States, the European Commission and the European Board for Digital Services, the point of contact is the e-mail info@aiprace.tech; you can write in Slovak or English.
9.Decision, statement of reasons and redress
If we remove a listing or restrict its visibility, debit points, or restrict or withdraw access to the Exchange, we tell the person concerned with a clear and specific statement of reasons (Article 17 DSA), at the latest when the measure takes effect. You will find it in your account in the section for the survey exchange and, if we know your e-mail address, you will also receive it by e-mail. The statement of reasons contains:
- which measure we took and how long it lasts,
- the facts and circumstances the decision rests on, and whether it was taken on a report or on our own initiative; we name the person who reported only where strictly necessary,
- whether we used automated means (we do not),
- the legal ground and an explanation where the content is unlawful, or the provision of these rules and an explanation where they were breached,
- the means of redress.
Means of redress.
- Within 6 months of the notice you may ask in writing, at info@aiprace.tech, for the decision to be reviewed. A person reviews it, we tell you the reasoned result without undue delay, and if the decision turns out to have been wrong we change it.
- Where an out-of-court dispute settlement body certified under Article 21 DSA is available for our decision, you may turn to it.
- You may lodge a complaint about a breach of the DSA with the digital services coordinator in the Member State where you live or in the Slovak Republic, where we are established.
- You may go to court. A consumer may also turn to a body for alternative resolution of consumer disputes under the Complaints policy (www.aiprace.tech/legal/reklamacie).
10.Our role and liability
The Provider runs a list. We do not check, approve or rate listings or questionnaires before they are published, and a listing is not a confirmation that the research is ethical, lawful or of good quality. We are not responsible for the content of listings and questionnaires or for the conduct of publishers and respondents, and we are not a party to the relationship between a publisher and a respondent. Content that we learn is unlawful or in breach of these rules we remove under parts 8 and 9.
These rules do not exclude or limit any liability that cannot be excluded by law, or a consumer’s rights under the Terms of Service and the mandatory law of the state of their habitual residence.
The Exchange is a means of finding respondents for research. It is not for writing final theses for others, and such use is forbidden (part 7).
11.Personal data
How the Provider processes data on listings, tickets, points and reports is described in article 14 of the Privacy policy (www.aiprace.tech/legal/gdpr). Only the pseudonym is shown publicly with a listing, never a name or e-mail. The Provider does not process the answers to questionnaires (part 4).
12.Changes, effect and contact
These rules form part of the Terms of Service (annex 2). In the use of the Exchange, where they conflict these rules apply first and the Terms of Service apply to everything else. We announce changes to the rules as set out in clause 16.2 of the Terms of Service. The Slovak version prevails.
